Eating Chicken from Fast Food Restaurants in Canada
Question: I heard that in Christian countries, eating chicken that does not have the "halal" label is considered permissible and allowed for us to eat. Based on this view, is it permissible for me to eat chicken from fast food restaurants such as A&W, Burger King, and Wendy’s in Canada, or should I avoid it?
Summary:
Whoever knows that the meat was slaughtered by electrocution or strangulation, it is not permissible for him to eat it. Whoever is unaware of the method, there is a scholarly difference, and the cautious approach is to avoid it until it becomes clear.
Answer:
In the name of Allah, all praise is due to Allah, and may Peace and Blessings be upon the Messenger of Allah (ﷺ)
Meat that comes from Western countries (such as Canada and Europe) is examined based on the method of slaughter:
- If it was slaughtered in a Sharīʿah-compliant manner (that is, by cutting the throat and the two jugular veins), and it was slaughtered by a Jew or a Christian, then it is ḥalāl.
- But if it is certainly known that it was killed by electrocution or by other forbidden methods, then it is ḥarām.
- And if the matter is unclear and it is not known whether it was slaughtered according to Sharīʿah or not, then scholars have differed:
The first opinion (caution and prohibition):
This was stated by:
Shaykh ʿAbdullāh ibn Ḥumayd, Shaykh Ṣāliḥ al-Fawzān, and others.
They based this on the principle that the default regarding meat is prohibition until permissibility is confirmed, so one must refrain unless the Sharīʿah-compliant method is verified.
The second opinion (permissibility):
This was stated by:
Shaykh Ibn Bāz, Shaykh Ibn ʿUthaymīn, and Shaykh ʿAbdullāh Āl Maḥmūd.
They based this on the principle that the default ruling of the slaughter of Ahl al-Kitāb is permissibility, and it is not required to ask about the method, unless the prohibition is certainly known.
The preferred view:
The first view is closer to caution and piety, especially given the widespread presence of non-Sharīʿah-compliant methods in the West.
The second view is broader and easier, but it is conditional on the absence of confirmed violations.
And Allah knows best.
