Engagement, Online Nikāh, and When a Husband Becomes a Mahram
Question: I wanted to ask: What is the ruling or status of a “fiancée” in Islam? And when do I officially become a mahram for my wife? And can a person be a mahram to his wife if she has not yet left her family’s home? (Meaning: if we perform the marriage contract online because I cannot return this year.)
Summary:
The fiancée is a non-mahram before the marriage contract. The husband becomes a mahram to his wife immediately after the valid nikāh. Her remaining in her family’s home does not change the ruling. An online nikāh is valid if its conditions are fulfilled.
Answer:
In the name of Allah, all praise is due to Allah, and may Peace and Blessings be upon the Messenger of Allah (ﷺ)
First: What is the status of a “fiancée” in Islam?
Engagement (khitbah) is only a promise of marriage; it is not a marriage, and none of the rulings of marriage become valid through it.
Before the marriage contract, the fiancée remains a non-mahram woman to the one proposing. It is not permissible for him to be alone with her, nor to touch her, nor to look at her except the permissible look when intending marriage.
From the Qur'an:
- (An-Nur 24:30)
“Tell the believing men to lower their gaze.”
From the Sunnah:
- Bukhari (5233) Narrated Ibn 'Abbas (RA):
The Prophet (ﷺ) said: "A man must not be alone with a woman except in the presence of a Mahram." [al-Bukhari reported it].
For this reason the scholars unanimously agree that the fiancé does not become a mahram to his fiancée, and she is not lawful for him until after the valid marriage contract.
Second: When do I officially become a mahram to my wife? You become a mahram to your wife as soon as a valid marriage contract is concluded, regardless of where the contract is carried out and even if the actual wedding or consummation is delayed. Once the contract is completed with its Islamic conditions the guardian, two witnesses, and offer and acceptance the woman becomes your lawful wife and all the rulings apply, including: Permissibility of being alone with her Permissibility of traveling with her She becomes a permanent mahram for you Marital rights become established Delaying consummation is a cultural matter and does not change the Islamic ruling. Third: Can I be her mahram if she stays in her parents’ home after the contract? Yes. The husband becomes a mahram to his wife as soon as the contract is completed, even if she remains in her family’s home and even if she has not yet moved to the marital home. This is similar to how the Prophet ﷺ would marry some of his wives and only consummate the marriage after some time, yet they were considered his wives from the moment of the contract.
From the Sunnah:
- (Reported by an-Nasā’ī and authenticated by al-Albānī)The Prophet ﷺ also said regarding a woman whose husband died after the contract but before consummation:
“She must observe the ‘iddah and she inherits.”
This shows that the effects of the contract are fully established even without consummation. Fourth: The validity of a marriage contract performed online If the contract is conducted through modern communication means with audio and video, and the conditions are met: Presence of the guardian Two witnesses Offer and acceptance Identity verification and absence of fraud or deception Then the contract is valid according to the majority of contemporary scholars, and this is the ruling issued by several recognized Islamic councils.
And Allah knows best.
